Acceptable Use Policy

1. Introduction

ABC Solutions objective is to provide and maintain the highest quality of Internet services available. We must, therefore, maintain the integrity of not only our own network, but also the networks of the Internet community at large. In order to do so, ABC Solutions prohibits certain practices and behaviors it deems detrimental to both its own network and to the Internet community at large.

This Acceptable Use Policy ("AUP" or "Policy") is designed to keep ABC Solutions and the Internet enjoyable and useful for all of our subscribers. Please read this document carefully before accessing the Internet through ABC Solutions. By accessing or using the Internet through us, you agree to be bound by the terms and conditions set forth below. If you do not wish to be bound by these terms and conditions, you may not access or use our services. Violation of this Policy may result in suspension or cancellation of ABC Solutions services.

ABC Solutions is committed to and supports the free flow of information and ideas over the Internet. We do not actively monitor nor do we exercise editorial control over the content of any web site, electronic mail transmission, mailing list, news group or other material created or accessible over our services. However, ABC Solutions does reserve the right to remove any materials we become aware of that are, at our sole discretion, potentially illegal, could subject us to liability, or in violation of this Policy.

This policy should be read in conjunction with the ABC Solutions Billing Policy.

2. Policies

The following are violations of ABC Solutions policies:

2.1. Using a personal account for high volume use. If you would like us to provide high-volume services, please contact Corporate Sales for information about opening up a commercial account.

2.2. Using ABC Solutions services for illegal purposes, or in support of illegal activities. We reserve the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrong. Activities which are prohibited as potentially illegal include, but are not limited to:

2.2.1. Unauthorized copying of copyrighted material including, but not limited to, digitization and distribution of photographs from magazines, books, or other copyrighted sources, copyrighted software, copyrighted music, copyrighted movies and copyrighted video.

2.2.2. Exporting software or technical information in violation of U.S. export control laws.

2.2.3. Posting or emailing of scams such as 'make-money-fast' schemes or 'pyramid/chain' letters.

2.2.4. Threatening bodily harm or property damage to individuals or groups.

2.2.5. Making fraudulent offers of products, items, or services originating from your account.

2.2.6. Attempting to access the accounts or computers of others, or attempting to penetrate beyond security measures of our or other systems (referred to as hacking) whether or not the intrusion results in corruption or loss of data.

2.3. SPAMing or Mail Bombing, i.e. sending large quantities of unsolicited e-mail to individual or business e-mail accounts anywhere, attempts at culling e-mail addresses from WWW, Usenet, other net providers, or any other commonly used net service, or engaging SMTP servers anywhere on the internet via a Port 25 SMTP session is prohibited. ABC Solutions will not tolerate the abuse of any SMTP server or gateway for "bouncing" or forwarding of unsolicited e-mail or the use of such facilities for masking the point of origin or identity of any party sending large quantities of unsolicited e-mail.

2.4. Knowingly operating a compromised server on the ABC Solutions network, e.g. our open mail relay, open proxy, trojaned, or other security compromised service will not be tolerated. ABC Solutions expects the customer to be cooperative in rectifying any computer security issue once ABC Solutions notifies the user that there may be a problem. The ABC Solutions network includes all dial-up, dedicated access (DSL, Frame-Relay, and T1) and co-located servers.

2.5. Revealing your account password to others or allowing use of your account by others (other than authorized users).

2.6. Forging any message header, in part or whole, of any electronic transmission, originating or passing through ABC Solutions services.

2.7. Distributing viruses to or from ABC Solutions systems.

2.8. Use of software or any device that would allow your account to stay logged on while you are not actively using ABC Solutions services. Using a personal account and/or business dialup account for high volume use is prohibited. The Services are intended for periodic, active use of email, newsgroups, file transfers, Internet chat, games, and browsing the World Wide Web. Members may stay connected so long as they are actively using that connection for the above purposes. Members may not use the Services on a standby or inactive basis in order to maintain a connection. Accordingly, ABC Solutions maintains the right to terminate any member's connection following any extended period of inactivity as determined by ABC Solutions. Accounts found in continued violation of this section will be charged a higher rate for service or may have their account terminated.

2.9. Cross-posting advertisements for products, items, or services to ten (10) or more unrelated USENET newsgroups.

2.10. Posting articles to any USENET or other news group, mailing list or similar forum that are off-topic according to the charter or other public statement of the forum.

2.11. Disrupting any newsgroup with frivolous, excessively vulgar, or repetitious postings.

2.12. Posting of binary, or excessively large, unrelated text files to non-binary news groups that have specifically requested such material not be posted in the group's FAQ (Frequently Asked Questions).

2.13. Installation of 'auto-responders', 'cancel-bots' or similar automated or manual routines which generate excessive amounts of net traffic, or disrupt net newsgroups or email use by others.

2.14. Engaging in any of the above activities using the service of another provider but channeling such activities through an ABC Solutions account or re-mailer, or using an ABC Solutions account as a mail drop for responses.

2.15. Uploading/running non-sanctioned Linux/Unix binary executables to any ABC Solutions server is expressly prohibited and may result in account suspension or termination.

3. Limits of Liability

3.1. ABC Solutions has no practical ability to restrict any conduct, communications or content which might violate this Policy prior to transmission on ABC Solutions Network, nor can we ensure prompt removal of any such communications or content after transmission or posting. Accordingly, ABC Solutions does not assume liability to subscribers or others for any failure to enforce the terms of this Policy.

3.2. You assume total responsibility and risk for your use of the Internet. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the Internet.

3.3. Except for information, products or services clearly identified as being supplied by ABC Solutions, ABC Solutions does not operate, control or endorse any information, products, or services on the Internet in any way. Except for the previously identified services, all information, products, or services offered on the Internet are generally offered by third parties that are not affiliated with ABC Solutions.

3.4. ABC Solutions cannot and does not guarantee or warrant that files available for downloading through the web site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output and for maintaining a means external to the site for the reconstruction of any lost data.

3.5. ABC SOLUTIONS DOES NOT WARRANT THAT THE SERVICES PROVIDED WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT DEFECTS IN THE SERVICE WILL BE CORRECTED. SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

3.6. IN NO EVENT WILL ABC SOLUTIONS BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, OR ANY INFORMATION OR TRANSACTIONS PROVIDED ON THE SERVICE, OR DOWNLOADED FROM THE SERVICE, OR ANY DELAY OF SUCH INFORMATION OR SERVICE.

4. Revisions to this Policy

ABC Solutions reserves the right to modify this Policy at any time. Notice of modifications to this Policy may be given to subscribers by posting such changes to the ABC Solutions homepage (http://www.abcsolve.com), by electronic mail, or by conventional mail.
